Upon death, a person's estate is one's collection of personal property, real estate, and other assets and liabilities that exist at the time of death. The only person legally able to administer or divide a deceased’s estate in Ontario is an Estate Trustee.
The process of applying for probate in order to qualify as an Estate Trustee involves asking a Court to validate authenticity of a deceased’s Will which appoints an Estate Trustee.
In order to manage an estate, probate is not always necessary. The probate status of an estate is determined by the nature of assets owned upon death. In most cases, if the deceased owned real estate or assets held by a financial institution, probate of a Will is typically required. In certain situations, an estate trustee may choose to go through probate, even though not required, in order to benefit from the legal protection it provides for distributing estate assets according to the will. Upon granting a probate application, the court will issue a certificate of appointment of an estate trustee, which serves as evidence of a person’s legal appointment to manage the estate and the validity of the last will of the deceased.
At the law offices of Stephen H. Shub we offer legal services in processing probate applications for the court’s Issuance of a Certificate of Appointment of Estate Trustee.
