What is Probate?

Upon death, a person's estate is their collection of personal property, real estate, and other assets and liabilities that exist at the time of death. The only person legally able to administer or divide a deceased person's estate in Ontario is an Estate Trustee.

The process of applying for probate in order to qualify as an Estate Trustee involves asking a Court to validate the authenticity of a deceased’s Will, which appoints an Estate Trustee.

When Might Someone Submit a Probate Application to the Court?

In order to manage an estate, probate is not always necessary. The probate status of an estate is determined by the nature of assets owned upon death.

When Probate Is Needed or Legally Beneficial

In most cases, if the deceased owned real estate or assets held by a financial institution, probate of a Will is typically required. In certain situations, an estate trustee may choose to go through probate, even though it is not required, in order to benefit from the legal protection it provides for distributing estate assets according to the Will.

Validating the Will Through Court Appointment

Upon granting a probate application, the Court will issue a Certificate of Appointment of Estate Trustee, which serves as evidence of a person’s legal appointment to manage the estate and the validity of the last Will of the deceased.
